Business and Commercial Litigation

The Firm represents plaintiffs and defendants in both complex commercial and general business litigation cases. These business cases involve all types of disputes, including breach of contract, business torts (including tortious interference with business and contractual relations, and business fraud), deceptive trade and unfair competition, corporate and partnership disputes, business disparagement, enforcement and challenging of non-compete agreements, fiduciary duty issues involving corporate officers and directors, shareholder derivative and oppression suits, sworn accounts, and matters involving the Uniform Commercial Code.

Class Actions

Dow Golub Remels & Gilbreath lawyers have experience in litigating nationwide and statewide class actions in state and federal courts, including representing both plaintiffs and defendants. We have experience in all aspects of class action litigation, including litigating the class certification itself, conducting class and merits discovery, negotiating settlements and obtaining approval — including those in which there are objectors.

Construction Litigation

We have experience in construction litigation and alternative dispute resolutions, having litigated construction matters involving contract and quantum meruit disputes, subcontractor and landlord disputes, mechanic’s lien issues, public work disputes, collections, and claims based on delay and disruption. The Firm has handled construction disputes in the Texas Courts of Appeals.

Employment Litigation

Representative matters handled by our attorneys include: (i) job discrimination matters arising under Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Equal Pay Act, and the Texas Commission on Human Rights Act; (ii)representation during investigations conducted by the EEOC; (iii) overtime matters arising under the Fair Labor Standards Act; (iv) issues involving the Family and Medical Leave Act; (v) suits to recover wrongly denied ERISA benefits; (vi) breach of contract; and (vii) representation before the Texas Workforce Commission.

Landlord and Tenant

Our attorneys have extensive experience representing commercial and residential property owners, REIT’s, and property managers in all aspects of landlord-tenant litigation, including forcible detainer and forcible entry and detainer proceedings, actions for damages, and suits for rent. We are cognizant of the time pressures often associated with these types of cases, and are skilled in pursuing and enforcing landlords’ rights in a prompt and efficient manner.

Real Property Litigation

The Firm regularly handles cases across the broad spectrum of real estate litigation representing developers, lenders, buyers and sellers in disputes involving construction and land use matters, partition issues, toxic mold, specific performance actions, boundary and easement disputes, lien priority and enforceability issues, inverse condemnation and eminent domain matters, adverse possession claims, contractor and subcontractor issues, quiet title, and mechanic’s and materialmen lien claims.

Personal Injury and Wrongful Death

Securities and Fraud Litigation and Arbitration

The Firm has experience representing individuals, corporations and their directors and officers, and other professionals in securities litigation, including representation of directors and officers in negligence and breach of fiduciary duty litigation; shareholders, general partners, and corporations in control contests, corporate governance and proxy litigation, and involvement in claims against brokers and brokerage firms.

Trade Secrets

The Firm represents companies and individuals in trade secret litigation and counsel these clients on, and prepare, trade secret licensing and assignment agreements, confidentiality agreements, employment agreements and covenants not to compete. Past representation has included (i) obtaining temporary restraining orders and injunctive relief against former employees who had wrongfully misappropriated our client’s trade secrets; (ii) defending a client against claims that its newly-hired employees had misappropriated customer lists constituting trade secrets from a former employer; (iii) advising small businesses regarding how to avoid liability for trade secret misappropriation; and (iv) advising clients about methods to treat confidential information in order to maximize the chances that it will qualify as a trade secret, and about procedures our clients can adopt to reduce the risk of misappropriation of such information.
